1. Agreement to Terms

These Terms of Use ("Terms") govern your access to and use of the Zodiara mobile application, website, and related services (collectively, the "Services"). By using the Services, you agree to these Terms. If you do not agree, do not use the Services.

2. Eligibility

  1. You must be at least 13 years old (or older if required by your jurisdiction).
  2. If you are under the legal age of majority in your jurisdiction, you may use the Services only with parental/guardian consent and supervision.
  3. If you use the Services on behalf of another person or entity, you represent that you are authorized to bind them to these Terms.

3. Privacy

Your use of the Services is also governed by our Privacy Policy.

4. License and Intellectual Property

  1. Subject to these Terms, Zodiara grants you a limited, revocable, non-exclusive, non-transferable, non-sublicensable license to use the Services for personal, non-commercial purposes.
  2. The Services, including software, design, text, graphics, logos, and related materials are owned by or licensed to Zodiara and protected by applicable laws.
  3. Except as expressly allowed, you may not copy, resell, modify, reverse engineer, distribute, scrape, or otherwise exploit the Services.

5. Prohibited Conduct

You agree not to:

  1. use the Services in violation of applicable laws;
  2. upload unlawful, infringing, harmful, or deceptive content;
  3. interfere with or disrupt the Services, security features, or infrastructure;
  4. attempt unauthorized access to accounts, systems, or data;
  5. use bots, scrapers, or automated tools without our written consent;
  6. misuse subscriptions, payment systems, or in-app purchase mechanisms.

6. User Content

  1. You are responsible for content you submit or generate through the Services ("User Content").
  2. You represent that you have all rights necessary to use and share your User Content, and that it does not infringe third-party rights or violate law.
  3. You grant Zodiara a worldwide, non-exclusive, royalty-free license to host, process, reproduce, and display User Content solely as needed to operate, improve, and provide the Services.

7. Subscriptions and In-App Purchases

  1. Certain features may require paid subscription or in-app purchase through Apple App Store, Google Play, or other authorized marketplaces.
  2. Payments, renewals, and refunds are handled by the applicable marketplace under its own terms and policies.

8. Third-Party Services

The Services may contain links or integrations with third-party services. We do not control and are not responsible for third-party content, policies, or practices.

9. Disclaimer of Warranties

To the fullest extent permitted by law, the Services are provided "as is" and "as available" without warranties of any kind, express or implied.

10. Limitation of Liability

To the fullest extent permitted by law, Zodiara and its affiliates will not be liable for indirect, incidental, special, consequential, or punitive damages, or loss of data, profits, or goodwill arising out of or related to your use of the Services.

11. Indemnification

You agree to indemnify and hold harmless Zodiara and its affiliates from claims, liabilities, losses, and expenses (including reasonable legal fees) arising from your use of the Services, your User Content, or your breach of these Terms.

12. Suspension and Termination

We may suspend or terminate your access to the Services, in whole or in part, at our discretion, including where we reasonably believe you violated these Terms or applicable law.

13. Changes to Terms

We may update these Terms from time to time. Updated Terms will be posted with a revised "Last updated" date. Your continued use of the Services after updates become effective means you accept the revised Terms.

14. Governing Law and Disputes

Unless otherwise required by mandatory local law, these Terms are governed by the laws applicable in your principal place of residence, and disputes will be handled by competent courts in that jurisdiction.
